Terms of Service

These Terms of Service (“Terms”) govern your access to and use of SiteChat, provided by lab.radical (“we”, “our”, “us”), Sydney, Australia. By using SiteChat, you agree to these Terms.
1. The Service
SiteChat provides an AI-powered chat widget that you can embed on your website. The widget reads your publicly accessible web pages and uses that content to answer questions from your website visitors. SiteChat also provides a dashboard for managing your widget, viewing conversation history, and accessing lead data.
2. Account Registration
You must provide a valid email address to create an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@sitechat.labradical.com.au if you suspect unauthorised access.
3. Free Trial and Subscriptions
New accounts receive a 14-day free trial with no credit card required. After the trial period, continued use requires a paid subscription. Subscription fees are charged monthly in advance. All fees are non-refundable except as required by Australian consumer law.
You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period. We do not charge cancellation fees.
4. Reply Limits
Each plan includes a monthly reply limit. When you reach this limit, your chatbot will pause responses until the next billing cycle or until you upgrade. We will notify you by email when you approach and reach your limit. Lead and message collection continues even when replies are paused.
5. Acceptable Use
You agree not to use SiteChat to:
- Violate any applicable law or regulation
- Deceive or mislead your website visitors
- Distribute spam, malware, or harmful content
- Infringe the intellectual property rights of others
- Circumvent usage limits or access controls
- Resell or white-label the service without an Agency plan or separate agreement
- Scrape or extract data from SiteChat's infrastructure beyond normal usage
We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.
6. Content and Data
You retain ownership of your website content and any visitor data collected through your widget. By using SiteChat, you grant us a limited licence to access your publicly available web pages solely for the purpose of generating chatbot responses.
You are responsible for ensuring your use of SiteChat complies with all applicable privacy laws, including notifying your website visitors that an AI chatbot is present and may collect their contact information.
7. AI-Generated Responses
SiteChat uses large language models (LLMs) to generate responses. While we strive for accuracy, AI responses may occasionally be incorrect, incomplete, or outdated. You acknowledge that SiteChat is a tool to assist, not replace, human support, and you are responsible for the information presented to your visitors via the widget.
8. Service Availability
We aim to maintain high availability but do not guarantee uninterrupted service. Planned maintenance, outages, or events beyond our control may cause temporary interruptions. We will communicate significant outages via email or our status page.
9. Limitation of Liability
To the maximum extent permitted by law, lab.radical shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, or data, arising out of or in connection with your use of SiteChat. Our total liability to you for any claim shall not exceed the total fees paid by you in the three months preceding the claim.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under Australian Consumer Law.
10. Australian Consumer Law
Our services come with guarantees under the Australian Consumer Law that cannot be excluded. Where we are permitted to limit our liability, we limit it to re-supplying the services or refunding the cost of the services, at our discretion.
11. Intellectual Property
SiteChat, its logo, software, and all associated intellectual property are owned by lab.radical. Nothing in these Terms transfers any IP rights to you. You may not copy, modify, distribute, or reverse-engineer any part of our service.
12. Changes to Terms
We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
